One early morning in January of 2012, an intoxicated racecar driver, who was out socializing with friends in South Beach, was driving north on Collins Avenue in Miami Beach. The victim, who had just gotten off of work, was on the sidewalk loading his bicycle into the back of a car parked in a loading zone. The driver suddenly lost control of his SUV, jumped the curb onto the sidewalk, struck and instantly killed the victim. The driver, an underage drinker, was charged criminally with DUI Manslaughter and Vehicular Homicide. Zebersky Payne Shaw Lewenz, LLP brought a wrongful death action against the driver on behalf of the decedent’s Personal Representative and the Estate.
Lee Gill Cohen, utilizing his 22 years of experience as a former prosecutor, including 16 years as the Chief Assistant in charge of the Broward State Attorney’s Office’s County Court/DUI Unit, guided the family through the often daunting Civil and Criminal Justice Systems. He regularly appeared before both courts on the family’s behalf, making sure that their rights both as survivors and victims of crime were protected and that justice was served.
Almost 18 months after the tragic accident that took their loved one from them, the surviving family members received their just closure in both the Civil and the Criminal proceedings. The parties entered into a confidential settlement agreement and the Wrongful Death action was amicably resolved to the satisfaction of all parties. The Defendant also resolved the criminal matter with a disposition that included all suggestions from the victim’s family members that honored the decedent’s memory.
