If you are a Crime Victim, you have certain rights under the law in regards to the criminal case as well as possible civil remedies.

If you are a Crime Victim, you have certain rights under the law in regards to the criminal case as well as possible civil remedies. In other words, from one criminal episode, you can have two separate actions in two separate systems of justice:

Criminal Case/Action

(also known as the Criminal Justice System) – In this court, the suspect or accused is charged with a crime and is facing criminal sanctions including jail.  The Plaintiff is the State or Government and the suspect or accused is the Defendant.  The Victim is a witness in the case with certain additional rights provided by the Constitution and statutes, but is not a party to the action.  The criminal action must be proven beyond a reasonable doubt.

Civil Case/Action

In this court, a civil action or lawsuit can be brought by the Victim (or family member) as the Plaintiff against the same criminal Defendant or party responsible for the Defendant’s actions (i.e. an insurance company) for money damages. The civil action must be proven by a much lower standard than a criminal action – by a preponderance (majority) of the evidence.

Civil Cases

Crime Victims also often have civil remedies available to them for money damages separate and apart from what you would be entitled to as the Victim of a crime.For Example:

If you or your family member are injured or killed by someone Driving Under the Influence or by someone driving recklessly, you may be able to bring a civil action against:

  • The impaired (drunk) driver
  • The owner of the vehicle being driven by the impaired driver
  • An automobile insurance company
  • A person or establishment responsible for the driver’s impairment (i.e. bar driver was drinking)

As the Victim of a shooting, stabbing or battery at a business, you may be able to bring a civil action against:

  •  The perpetrator who committed the crime against you
  •  The business or person or entity responsible for the premises.

As the Victim of Theft or Financial Exploitation (i.e. scams, embezzlement, fraud, thefts by caregivers), you may be entitled to bring an action:

  • Against the perpetrator for treble (three times) the amount of the financial loss under the civil theft statute.
  • Against any person, entity or financial institution that assisted or facilitated the theft or exploitation.
  • Will strive to determine whether the Defendant or other entities such as insurance companies can he held civilly liable for the Defendant’s criminal acts, and if appropriate, will file a lawsuit for money damages against the responsible party
  • Will work with the police, prosecutors and Victim Advocates to protect your rights as a Victim.
  • Will be by your side throughout the civil and criminal processes, including appearing with you in criminal court and at depositions, and will explain to you the process and your rights.
