What To Know About Class Action Lawsuits & Mass Torts?
Zebersky Payne, LLP, represents consumers in class action lawsuits in the state of Florida and throughout the country.
We handle all types of class action lawsuits, including the following:
- Insurance claims
- False advertising
- Violation of consumer protection laws
- Defective products
- Dangerous drugs
- Cruise Ship Negligence
- Food Poisoning
- Civil rights
When corporations, insurance companies, or other types of businesses take actions or make policies that adversely affect a large number of people, we have the resources and skills to file a class action suit to seek justice for those who have been wronged. Even if each individual victim’s loss or injury may not be sufficient to constitute a lawsuit on its own, the attorneys of Zebersky Payne understand the power of the class action lawsuit to bring a full cup of justice to our clients. In our justice system, a company that causes small damages to thousands of people should be treated the same as a company or person who causes a catastrophic injury or loss to a single person. By banding together as a class of victims, these individuals can affect change in a corporation’s actions and policies, and ultimately obtain full and fair justice for all.
Do not allow a corporation to get away with harming innocent individuals.

What is a Class Action Lawsuit?
If you are injured by a dangerous medication, defective medical device, or exposure to a toxic substance, you deserve compensation from the companies responsible for your injuries. These injuries can result in substantial medical bills, physical and mental pain and suffering, lost wages, temporary or permanent disability or even death.
You Deserve Justice
Overwhelming medical expenses and an inability to work due to injuries resulting from a defective or dangerous product can cause stress and financial disaster for you and your family. In severe cases, your injuries can lead to the loss of your job, your home, medical insurance coverage for you and your family, and in some cases, your life.
Zebersky Payne is dedicated to ensuring that you and your family obtain the justice you deserve by holding companies responsible for their actions in developing, marketing, selling, and distributing a dangerous or defective product.
Examples of Mass Tort
Some common examples of mass torts include:
- Defective medical devices or dangerous or bad medications.
- Other mass torts arise out of disastrous circumstances such as toxic environmental spills, plane crashes, or bridge collapses, where a large number of people are injured or killed.
- The nationwide tobacco company litigation is another example of mass torts litigation.
How Does Mass Torts Work?
When a defective or dangerous product injuries a large group of people, the injured persons often consolidate their individual claims together. This results in a mass tort claim, which involves numerous plaintiffs bringing lawsuits against one or more responsible parties or defendants. Since all of the injured plaintiffs have the same goal – to recover money damages for their injuries from a defective product – the individual lawsuits can proceed together for most of the litigation, or until the cases go to trial.
A mass tort claim results in substantial savings in time and costs by allowing the pre-trial discovery process for each individual claim – such as depositions, production of written documents, and other evidence related matters – to be accomplished collectively. Once these pre-trial proceedings are complete, however, the mass torts cases are scheduled individually for trial. This procedure allows each claim to be tried separately based on an individual’s specific injuries, which may differ in substance and severity from one plaintiff to the next.
A mass torts case differs from a class action lawsuit in that many separate lawsuits proceed to trial, as opposed to individual claims that are litigated in the same trial.
