The American system of justice generally allows litigants (the parties involved in a lawsuit) to choose between a jury trial and a bench trial. In a jury trial, the jury decides questions of fact and the judge applies the law. In a bench trial, the judge determines all questions of law and also decides all questions of fact. Eyewitness Identification Evidence
While very dramatic at trial, eyewitness evidence can be unreliable. Numerous scientific studies have been conducted on the accuracy of eyewitness identification. Some social scientists estimate that erroneous eyewitness identification is responsible for a large percentage of wrongful convictions. However, jurors tend to believe that eyewitness testimony is accurate. This article discusses the factors that affect the accuracy of eyewitness identification and what the courts are doing to reduce the number of wrongful convictions.

The United States Supreme Court and Judicial Review
The United States Constitution establishes three branches of government--the executive, the legislative, and the judicial. The executive branch, headed by the President of the United States, carries out, executes, and administers the law. The United States Congress, the legislative branch of government, makes or enacts the law. The judicial branch, headed by the United States Supreme Court, interprets laws and resolves disputes that arise under the laws.
The Supreme Court of the United States
The United States Constitution provides that the judicial power of the United States is vested in one Supreme Court and any lower courts established by the United States Congress. The Supreme Court was organized on February 2, 1790.
